✧ The Messenger of Allah ﷺ decreed the right of preemption in every property that has not been divided. But when boundaries are fixed and roads are laid out, there is no preemption.

machine translationAl-Zuhrī's ḥadīth on pre-emption (shufʿah) is a sound (ṣaḥīḥ) and well-known ḥadīth.

machine translationWhat I hold is that this much is the speech of the Prophet ﷺ: the Prophet ﷺ only established pre-emption (shufʿah) in what has not been divided at all. It seems that the rest of the statement is the speech of Jābir: "When it is divided and the boundaries have been set, there is no pre-emption." And God knows best.
