وَجَدْتُ فِي كِتَابِ أَبِي حَدَّثَنَا الْحَكَمُ بْنُ مُوسَى قَالَ عَبْدُ اللهِ وَحَدَّثَنَاهُ الْحَكَمُ بْنُ مُوسَى حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ عَنْ أَبِي وَهْبٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى أَنَّ نَافِعًا حَدَّثَهُ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ وَعَطَاءَ بْنَ أَبِي رَبَاحٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ

مَنْ بَاعَ عَبْدًا، وَلَهُ مَالٌ، فَلَهُ مَالُهُ وَعَلَيْهِ دَيْنُهُ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنْ أَبَّرَ نَخْلًا، فَبَاعَهُ بَعْدَ تَوْبِيرِهِ، فَلَهُ ثَمَرَتُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ

✧ Whoever sells a slave who has property, the property belongs to the slave, and the debt is upon him [the seller? or the slave’s debt remains with the slave? — render literally: “and against him is his debt”] unless the buyer stipulates otherwise. And whoever pollinates palm trees, then sells them after pollination, the fruit belongs to him unless the buyer stipulates otherwise.
