حَدَّثَنَا هَاشِمٌ حَدَّثَنَا لَيْثٌ حَدَّثَنِي ابْنُ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ أَنَّهُ قَالَ
قَضَى رَسُولُ اللهِ ﷺ فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لِحْيَانَ مِنْ هُذَيْلٍ سَقَطَ مَيِّتًا بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ، ثُمَّ إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ فَقَضَى رَسُولُ اللهِ ﷺ بِأَنَّ مِيرَاثَهَا لِبَنِيهَا وَزَوْجِهَا، وَأَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا.

✧ The Messenger of Allah ﷺ judged regarding a fetus of a woman from Banū Liḥyān of Hudhayl that was miscarried dead, that a ghurrah—a male or female slave—be given. Then the woman against whom the judgment of the ghurrah was given died, and the Messenger of Allah ﷺ ruled that her inheritance belongs to her sons and her husband, and that the blood money is upon her ʿaṣabah.
