حَدَّثَنَا إِسْحَاقُ حَدَّثَنِي مَالِكٌ عَنِ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنِ أَبِي هُرَيْرَةَ قَالَ
لَا تَلَقَّوُا الرُّكْبَانَ، وَلَا يَبِعْ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ، وَلَا تَنَاجَشُوا، وَلَا يَبِعْ حَاضِرٌ لِبَادٍ، وَلَا تُصَرُّوا الْإِبِلَ وَالْغَنَمَ، فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ، بَعْدَ أَنْ يَحْلُبَهَا؛ إِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ.

✧ Do not go out to meet the caravans [to intercept them before they reach the market]. No one of you should sell over the sale of another. Do not practice najash [bidding up prices without intent to buy]. A town-dweller should not sell on behalf of a bedouin. Do not leave the udders of camels and sheep unmilked [to make them appear full of milk]. Whoever buys such an animal after that has the choice between the two options after he has milked it: if he is pleased with it, he keeps it; and if he is displeased with it, he returns it along with a saaʿ of dates.

ذكر القعنبي من سماع أشهب عن مالك أنه سئل عن قول رسول الله صلى الله عليه وسلم من ابتاع مصراة فهو بخير النظرين بعد أن يحلبها إن شاء أمسكها وإن شاء ردها وصاعا من تمر وقال سمعت ذلك وليس بالثابت ولا الموطإ عليه وإن لم يكن ذلك أنه له اللبن بما أعلف وضمن قيل له نراك تضعف الحديث قال كل شيء يوضع موضعه وليس بالموطأ ولا الثابت وقد سمعته
