أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
قَالَ لِي عَطَاءٌ: وَسَأَلْتُهُ، فَقَالَ: إِنْ كَانَا نَصْرَانِيَّانِ فَأَسْلَمَ أَبُوهُمَا، وَلَهُمَا أَوْلَادٌ صِغَارٌ، فَمَاتَ أَوْلَادُهُمْ وَلَهُمْ مَالٌ، فَلَا يَرِثُهُمْ أَبُوهُمُ الْمُسْلِمُ، وَلَكِنْ تَرِثُهُمْ أُمُّهُمْ، وَمَا بَقِيَ فَلِأَهْلِ دِينِهِمْ ". قُلْتُ: إِنَّهُمْ صِغَارٌ لَا دِينَ لَهُمْ، قَالَ: " وَلَكِنْ وُلِدُوا فِي النَّصْرَانِيَّةِ عَلَى النَّصْرَانِيَّةِ "، وَلَقَدْ كَانَ قَالَ لِي مَرَّةً: يَرِثُهُمُ الْمُسْلِمُ مِيرَاثَهُ مِنْ أَبِيهِمْ ". وَلَا أَعْلَمُهُ إِلَّا قَدْ كَانَ يَقُولُ: " يَرِثُهُمَا وَلَدُهُمَا الصَّغِيرُ، وَيَرِثَانِهِ حَتَّى يَجْمَعَ بَيْنَهُمَا دِينٌ أَوْ يُفَرِّقَ ". فَذَاكَرْتُهُ عَمْرَو بْنَ دِينَارٍ، قُلْتُ: أَبَوَاهُ نَصْرَانِيَّانِ ! قَالَ: " كُنْتُ مُعْطِيًا مَا لَهُمَا وَلَدَهُمَا ". قُلْتُ لِعَمْرٍو: وَكَيْفَ وَالْوَلَدُ عَلَى الْفِطْرَةِ ؟ قَالَ: " فَلِمَ تُسْبَى إِذًا أَوْلَادُ أَهْلِ الشِّرْكِ ؟ وَهُمْ عَلَى الْفِطْرَةِ، وَهُمْ مُسْلِمُونَ
Translation

machine translationʿAbd al-Razzāq informed us, from Ibn Jurayj, who said:
✧ Ata said to me—and I asked him—and he said: If two parents are Christians and their father embraces Islam while they have young children, and then their children die leaving wealth, their Muslim father does not inherit from them; rather their mother inherits from them, and what remains goes to the people of their religion. I said: But they are young and have no religion. He said: But they were born in Christianity upon Christianity. And he had once told me: The Muslim inherits from them, his share of inheritance from their father. And I do not think he ceased to say: Their young child inherits from both of them, and they both inherit from him until a religion either unites them or separates them. I discussed this with Amr b. Dinar, saying: But their parents are Christians! He said: I would give their wealth to their child. I said to Amr: How, when the child is upon the fitrah? He said: Then why are the children of the polytheists taken captive? They are upon the fitrah, and they are Muslims.
