✧ One who is overtaken by dawn in a state of janabah

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
قُلْتُ لِعَطَاءٍ أَيَبِيتُ الرَّجُلُ جُنُبًا فِي شَهْرِ رَمَضَانَ حَتَّى يُصْبِحَ يَتَعَمَّدُ ذَلِكَ، ثُمَّ يَصُومُ ؟ قَالَ: أَمَّا أَبُو هُرَيْرَةَ فَكَانَ يَنْهَى عَنْ ذَلِكَ، وَأَمَّا عَائِشَةُ فَكَانَتْ تَقُولُ: لَيْسَ بِذَلِكَ بَأْسٌ، فَلَمَّا اخْتَلَفَا عَلَى عَطَاءٍ قَالَ: يُتِمُّ يَوْمَهُ ذَلِكَ، وَيُبْدِلُ يَوْمًا
Translation
✧ I said to Ata: May a man spend the night junub in Ramadan, deliberately doing so, until morning comes, and then fast? He said: As for Abu Hurayrah, he used to forbid that; as for Aishah, she used to say: There is no harm in that. When they differed before Ata, he said: He should complete that day, and make up another day.
