عَبْدُ الرَّزَّاقِ، عَنْ مَالِكٍ، عَنْ مُحَمَّدِ بْنِ عُقْبَةَ،
أَنَّهُ سَأَلَ الْقَاسِمَ بْنَ مُحَمَّدٍ عَنْ مُكَاتَبٍ لَهُ قَاطَعَهُ بِمَالٍ كَثِيرٍ، هَلْ عَلَيْهِ فِيمَا أَخَذَ مِنْهُ زَكَاةٌ ؟ فَقَالَ الْقَاسِمُ: " إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ كَانَ لَا يَأْخُذُ مِنْ مَالٍ زَكَاةً حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ، وَكَانَ إِذَا أَعْطَى الرَّجُلَ عَطَاءً سَأَلَهُ هَلْ عِنْدَكَ مَالٌ وَجَبَ عَلَيْكَ فِيهِ زَكَاةٌ ؟ " فَإِنْ قَالَ: نَعَمْ أَخَذَ مِنْهُ مِنْ عَطَائِهِ زَكَاةَ ذَلِكَ الْمَالِ، وَإِلَّا سَلَّمَ إِلَيْهِ عَطَاءَهُ وَافِرًا
Translation
✧ He asked al-Qasim b. Muhammad about a mukatab of his with whom he had agreed on a large sum of money: is zakat due on what he took from him? Al-Qasim said, 'Abu Bakr al-Siddiq would not take zakat from any wealth until a year had passed over it. When he gave a man a stipend, he would ask him, “Do you have any wealth on which zakat is due?” If he said yes, he would deduct from his stipend the zakat of that wealth; otherwise he would hand over his stipend in full.'
