عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: كَتَبَ إِلَيَّ إِبْرَاهِيمُ بْنُ مَيْسَرَةَ أَنْ قَدْ ذَكَرَ لِي مَنْ لَا أَتَّهِمُ مِنْ أَهْلِي أَنْ قَدْ تَذَاكَرَ هُوَ وَعُرْوَةُ بْنُ مُحَمَّدٍ السَّعْدِيُّ بِالشَّامِ الْعَنْبَرَ، فَزَعَمَ عُرْوَةُ
أَنَّهُ قَدْ كَتَبَ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ يَسْأَلُهُ عَنْ صَدَقَةِ الْعَنْبَرِ، فَزَعَمَ عُرْوَةُ أَنَّهُ كَتَبَ إِلَيْهُ: " اكْتُبْ إِلَيَّ كَيْفَ كَانَ أَوَائِلُ النَّاسِ يَأْخُذُونَهُ ؟ أَمْ كَيْفَ كَانَ يُؤْخَذُ مِنْهُمْ ؟ " ثُمَّ اكْتُبْ إِلَيَّ قَالَ: إِنَّهُ قَدْ ثَبَتَ عِنْدِي أَنَّهُ كَانَ يُنَزَّلُ بِمَنْزِلَةِ الْغَنِيمَةِ، فَيُؤْخَذُ مِنْهُ الْخُمُسُ، فَزَعَمَ عُرْوَةُ أَنَّهُ كَتَبَ إِلَيْهِ " أَنْ خُذِ الْخُمُسَ، وَادْفَعْ مَا فَضَلَ بَعْدَ الْخُمُسِ إِلَى مَنْ وَجَدَهُ
Translation
✧ He wrote to Umar b. Abd al-Aziz asking him about the charity on ambergris. Urwa claimed that he wrote to him: “Write to me how the early people used to take it? Or how was it taken from them? Then write to me.” He said: It has been established with me that it was treated as spoils of war, so a fifth was taken from it. Urwa claimed that he wrote to him: “Take the fifth, and give what remains after the fifth to the one who found it.”
