عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنْ عُمَرَ قَالَ:

فِي الْأَرْبَعِينَ مِنَ الْغَنَمِ سَائِمَةً شَاةٌ إِلَى مِائَةٍ وَعِشْرِينَ، فَإِنْ زَادَتْ شَاةً فَفِيهَا شَاتَانِ إِلَى مِائَتَيْنِ، فَإِنْ زَادَتْ شَاةً فَفِيهَا ثَلَاثُ شِيَاهٍ إِلَى ثَلَاثِمِائَةٍ، فَإِنْ كَثُرَتِ الْغَنَمُ فَفِي كُلِّ مِائَةٍ شَاةٌ، وَلَا تُؤْخَذُ هَرِمَةٌ، وَلَا ذَاتُ عَوَارٍ، وَلَا تَيْسٌ إِلَّا أَنْ يَشَاءَ الْمُصَدِّقُ، وَفِي الْإِبِلِ فِي خَمْسٍ شَاةٌ، وَفِي عَشْرٍ شَاتَانِ، وَفِي خَمْسَ عَشْرَةَ ثَلَاثُ شِيَاهٍ، وَفِي عِشْرِينَ أَرْبَعُ شِيَاهٍ، وَفِي خَمْسٍ وَعِشْرِينَ بِنْتُ مَخَاضٍ، فَإِنْ لَمْ تَكُنْ بِنْتُ مَخَاضٍ فَابْنُ لَبُونٍ ذَكَرٌ، إِلَى خَمْسٍ وَثَلَاثِينَ، فَإِنْ زَادَتْ وَاحِدَةً فَفِيهَا بِنْتُ لَبُونٍ إِلَى خَمْسٍ وَأَرْبَعِينَ، فَإِنْ زَادَتْ وَاحِدَةً فَفِيهَا حِقَّةٌ طَرُوقَةُ الْفَحْلِ إِلَى سِتِّينَ، فَإِنْ زَادَتْ وَاحِدَةً فَفِيهَا جَذَعَةٌ إِلَى خَمْسَةٍ وَسَبْعِينَ، فَإِنْ زَادَتْ وَاحِدَةً فَفِيهَا ابْنَا لَبُونٍ إِلَى تِسْعِينَ، فَإِنْ زَادَتْ وَاحِدَةً فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْفَحْلِ إِلَى مِائَةٍ وَعِشْرِينَ، فَإِنْ زَادَتْ فَفِي كُلِّ أَرْبَعِينَ بِنْتُ لَبُونٍ، وَفِي كُلِّ خَمْسِينَ حِقَّةٌ، وَيُحْسَبُ صِغَارُهَا وَكِبَارُهَا، وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بِالسَّوِيَّةِ، وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ، وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ خَشْيَةَ الصَّدَقَةِ

Translation

✧ For forty pasturing sheep, one sheep, up to one hundred and twenty. If it increases by one sheep, then two sheep, up to two hundred. If it increases by one sheep, then three sheep, up to three hundred. If the sheep are abundant, then for every hundred, one sheep. An old one, a defective one, or a billy goat is not taken, unless the collector wishes. For camels: for five, one sheep; for ten, two sheep; for fifteen, three sheep; for twenty, four sheep; for twenty-five, a bint makhad; if there is no bint makhad, then a male ibn labun, up to thirty-five. If it increases by one, then a bint labun, up to forty-five. If it increases by one, then a hiqqah mounted by the stallion, up to sixty. If it increases by one, then a jadh'ah, up to seventy-five. If it increases by one, then two ibn labun, up to ninety. If it increases by one, then two hiqqahs mounted by the stallion, up to one hundred and twenty. If it increases, then for every forty, a bint labun, and for every fifty, a hiqqah. Their young and old are counted. If two partners mix their livestock, they settle between themselves equally. Combined herds are not separated, and separate herds are not combined for fear of zakat.
