✧ One Who Touches Another's Penis

عَبْدُ الرَّزَّاقِ عَنِ ابْنِ جُرَيْجٍ قَالَ:

قُلْتُ لِعَطَاءٍ: مَسَسْتُ قُنْبَ حِمَارٍ أَوْ ثَيْلَ جَمَلٍ، قَالَ: أَمَّا قُنْبُ الْحِمَارِ فَكُنْتَ مُتَوَضِّئًا، وَأَمَّا مِنْ ثَيْلِ الْجَمَلِ فَلَا قُلْتُ: فَمَاذَا يُفَرِّقُ بَيْنَهُمَا ؟ قُلْتُ: مِنْ أَجْلِ الْحِمَارِ وَهُوَ أَنْجَسُ قَالَ: وَأَقُولُ أَنَا: انْظُرْ كُلَّ شَيْءٍ نَجِسٍ كَهَيْئَةِ الْحِمَارِ لَا يُؤْكَلُ لَحْمُهُ مَسَّ مِنْهُ ذَلِكَ، فَعَلَيْهِ الْوُضُوءُ، وَكُلُّ شَيْءٍ يُؤْكَلُ لَحْمُهُ كَهَيْئَةِ الْبَعِيرِ مَسَّ ذَلِكَ مِنْهُ، فَلَا وُضُوءَ مِنْهُ

Translation

✧ I said to ʿAṭāʾ: I touched the sheath of a donkey or the penis of a camel. He said: As for the sheath of a donkey, you would perform ablution, but as for the penis of a camel, no. I said: What distinguishes between them? I said: Because of the donkey, which is more impure. He said, and I say: Consider everything impure like the donkey, whose flesh is not eaten—if one touches that part of it, ablution is incumbent on him. And everything whose flesh is eaten, like the camel—if one touches that part of it, no ablution is required from it.
