أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، قَالَ: أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ، قَالَ:
جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ تَطْلُبُ مِيرَاثَهَا مِنِ ابْنِ ابْنِهَا، أَوِ ابْنِ ابْنَتِهَا - لَا أَدْرِي أَيَّتُهُمَا هِيَ - فَقَالَ أَبُو بَكْرٍ: لَا أَجِدُ لَكِ فِي الْكِتَابِ شَيْئًا، وَمَا سَمِعْتُ رَسُولَ اللهِ ﷺ يَقْضِي لَكِ بِشَيْءٍ، وَسَأَسْأَلُ النَّاسَ الْعَشِيَّةَ، فَلَمَّا صَلَّى الظُّهْرَ، أَقْبَلَ عَلَى النَّاسِ، فَقَالَ: إِنَّ الْجَدَّةَ أَتَتْنِي تَسْأَلُنِي مِيرَاثَهَا مِنَ ابْنِ ابْنِهَا، أَوِ ابْنِ ابْنَتِهَا، وَإِنِّي لَمْ أَجِدْ لَهَا فِي الْكِتَابِ شَيْئًا، وَلَمْ أَسْمَعِ النَّبِيَّ ﷺ يَقْضِي لَهَا بِشَيْءٍ، فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ اللهِ ﷺ فِيهَا شَيْئًا ؟ فَقَامَ الْمُغِيرَةُ بْنُ شُعْبَةَ، فَقَالَ: شَهِدْتُ رَسُولَ اللهِ ﷺ يَقْضِي لَهَا بِالسُّدُسِ، فَقَالَ: هَلْ سَمِعَ ذَلِكَ مَعَكَ أَحَدٌ ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ: " شَهِدْتُ رَسُولَ اللهِ ﷺ يَقْضِي لَهَا بِالسُّدُسِ "، فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ، فَلَمَّا كَانَتْ خِلَافَةُ عُمَرَ جَاءَتْهُ الْجَدَّةُ الَّتِي تُخَالِفُهَا، فَقَالَ عُمَرُ: " إِنَّمَا كَانَ الْقَضَاءُ فِي غَيْرِكِ، وَلَكِنْ إِذَا اجْتَمَعْتُمَا فَالسُّدُسُ بَيْنَكُمَا، وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا
