عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
إِذَا أَوْصَى بِثُلُثِ مَالِهِ فَقَالَ هُوَ لِفُلَانٍ وَلِفُلَانٍ، ثُمَّ مَاتَ أَحَدُهُمْ فَهُوَ لِلْبَاقِي، وَإِذَا قَالَ: هُوَ بَيْنَ فُلَانٍ وَبَيْنَ فُلَانٍ فَمَاتَ أَحَدُهُمَا فَلِلْآخَرِ النِّصْفُ، وَإِذَا قَالَ: هُوَ لِفُلَانٍ وَلِهَذَا الْحَدَثِ فَهُوَ لِلرَّجُلِ كُلِّهِ، وَلَيْسَ لِلْحَدَثِ شَيْءٌ وَإِذَا أَوْصَى بِثَوْبِ فُلَانٍ لِفُلَانٍ، ثُمَّ اشْتَرَاهُ فَلَيْسَ بِشَيْءٍ؛ لِأَنَّهُ أَوْصَى بِهِ وَلَيْسَ لَهُ
