عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي مُكَاتَبٍ تُوُفِّيَ وَتَرَكَ مَالًا وَوَلَدًا مِنْ مُكَاتَبَةٍ وَعَلَيْهِ بَقِيَّةٌ مِنْ كِتَابَتِهِ قَالَ: " يَسْعَى وَلَدُهُ فِيمَا بَقِيَ مِنْ كِتَابَتِهِ، وَيَعْتِقُونَ بِعِتْقِهِ، فَإِنْ عَجَزُوا صَارُوا رَقِيقًا "، وَكَانَ حَمَّادٌ يَقُولُ: " صِغَرُهُمْ عَجْزٌ، لَا يُسْتَأْنَى بِهِمْ، يَقُولُ: هُمْ مَمْلُوكُونَ إِذَا مَاتَ أَبُوهُمْ " قَالَ سُفْيَانُ: " إِنْ لَمْ يُؤَدُّوا الْمَوَاقِيتَ فَصِغَرُهُمْ عَجْزٌ ".
