عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ التَّيْمِيِّ، عَنْ أَبِيهِ قَالَ: سَأَلْتُ الْحَسَنَ قَالَ:
قُلْتُ: امْرَأَةٌ عِنْدَنَا ضَعِيفَةٌ لَيْسَ لَهَا أَحَدٌ، أَتُوَلِّي رَجُلًا فَيُزَوِّجُهَا ؟ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّ. قَالَ: فَجَعَلْتُ أُرَادُّهُ فِيهَا، وَأُصَغِّرُ لَهُ أَمْرَهَا. فَقَالَ: " لَا نِكَاحَ لَهَا إِلَّا بِإِذْنِ وَلِيِّهَا ". قَالَ: فَلَمَّا أَكْثَرْتُ عَلَيْهِ، قَالَ: " وَاللهِ، مَا أَعْلَمُ إِلَّا ذَلِكَ ". قَالَ: قُلْتُ: فَالْقَاضِي ؟ قَالَ: " وَالْقَاضِي
