عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُ لِعَطَاءٍ:
امْرَأَةٌ نَكَحَتْ رَجُلًا بِغَيْرِ إِذْنِ الْوُلَاةِ وَهُمْ حَاضِرُونَ، فَبَنَى بِهَا. قَالَ: " وَأَشْهَدَتْ ؟ " قَالَ: نَعَمْ، قَالَ: " أَيُّمَا امْرَأَةٍ مَالِكَةٍ لِأَمْرِهَا، إِذَا كَانَ شُهَدَاءُ - فَإِنَّهُ جَائِزٌ دُونَ الْوُلَاةِ، وَلَوْ أَنْكَحَهَا الْوَلِيُّ كَانَ أَحَبَّ إِلَيَّ، وَنِكَاحُهَا جَائِزٌ
