عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
لَوْ أَنَّ رَجُلًا أَتَى قَوْمًا، فَقَالَ: إِنِّي عَرَبِيٌّ، فَتَزَوَّجَ إِلَيْهِمْ فَوَجَدُوهُ مَوْلًى كَانَ لَهُمْ أَنْ يَرُدُّوا نِكَاحَهُ. وَإِنْ قَالَ: أَنَا مَوْلًى فَوَجَدُوهُ نَبَطِيًّا رُدَّ النِّكَاحُ. فَإِنْ قَالَ: أَنَا عَرَبِيٌّ، فَكَانَ عَرَبِيًّا مِنْ غَيْرِ أُولَئِكَ الَّذِينَ انْتَمَى إِلَيْهِمْ - جَازَ النِّكَاحُ. وَإِنْ قَالَ: أَنَا مَوْلًى لِبَنِي فُلَانٍ، فَوَجَدُوهُ مَوْلًى لِغَيْرِهِمْ، جَازَ النِّكَاحُ ".
